GENERAL TERMS & CONDITIONS
PRELOVEDSTORY GmbH
1. GENERAL INFORMATION
These General Terms and Conditions (“GTCs”) govern the relationship between PRELOVEDSTORY GmbH (“PRELOVEDSTORY”) and its customers, including buyers and consignors (“Principals”).
PRELOVEDSTORY operates a curated luxury resale boutique and online store, offering pre-owned designer clothing, handbags, shoes, jewellery and accessories.
PRELOVEDSTORY sells both its own products and products on consignment in its own name but for the account of third-party owners, in accordance with Art. 425 et seq. of the Swiss Code of Obligations.
These GTCs apply to purchases made in-store and online, as well as to consignment arrangements, unless otherwise agreed in writing.
PRELOVEDSTORY reserves the right to amend these GTCs at any time. The version applicable at the time of purchase or conclusion of the relevant agreement shall govern that transaction.

2. RECEIPT OF CONSIGNMENT PRODUCTS
Products are accepted for consignment following prior consultation and approval by PRELOVEDSTORY.
All items must be presented in clean, well-maintained and saleable condition. PRELOVEDSTORY reserves the right to refuse items that do not meet its quality standards or to arrange cleaning at the Principal’s expense, subject to prior agreement.
The selection of products, selling prices, commission percentages and consignment period are agreed individually between PRELOVEDSTORY and the Principal in a Consignment Agreement. Confirmation by email is sufficient.
Items not accepted for consignment must be collected by the Principal or may be returned at the Principal’s expense, as agreed.
3. COMMISSION PERIOD
The consignment period and the Principal’s share of the final selling price are specified in the individual Consignment Agreement.
PRELOVEDSTORY may negotiate the final selling price with prospective buyers within the terms agreed with the Principal.
Payment to the Principal is calculated based on the final selling price and the agreed commission percentage.
The handling of unsold items at the end of the consignment period is governed by the Consignment Agreement.
If the Principal fails to collect or arrange the return of unsold items after written notification, PRELOVEDSTORY may arrange storage or return at the Principal’s expense, subject to applicable law.
4. EARLY COLLECTION
If the Principal requests the return of an item before the agreed consignment period expires, PRELOVEDSTORY reserves the right to charge an administrative fee of CHF 100 per item, provided this fee was agreed in the Consignment Agreement.
5. PRODUCT CONDITIONS & DISCLAIMER
PRELOVEDSTORY specialises in pre-owned and vintage luxury goods. Items may show signs of previous use, age, natural wear or alterations.
We make every effort to describe and photograph products accurately, including relevant signs of wear and visible imperfections.
Minor variations in colour or appearance may occur due to lighting, photography or screen settings.
Product condition descriptions are based on our professional assessment and should be understood in the context of second-hand and vintage goods.
Customers purchasing in-store are encouraged to inspect items carefully before completing their purchase.
Condition categories are defined in the Annex to these GTCs.
Any exclusions or limitations of liability apply only to the extent permitted by applicable law.
6. AUTHENTICITY
PRELOVEDSTORY is committed to offering authentic luxury goods.
All products are assessed for authenticity to the best of our knowledge and expertise. Where appropriate, additional third-party authentication services may be used.
The Principal guarantees that all consigned products are authentic, legally owned and free from third-party claims.
Should a product be proven counterfeit, PRELOVEDSTORY will investigate the matter and provide the remedies required under applicable law.
The Principal shall be responsible for losses and claims arising from the consignment of counterfeit goods to the extent permitted by law.
PRELOVEDSTORY reserves the right to charge an administrative fee of CHF 500 for a counterfeit item submitted for consignment, where contractually agreed and legally enforceable, without prejudice to other applicable claims.
7. PRICES & AVAILABILITY
All prices are displayed in Swiss Francs (CHF), unless otherwise indicated.
PRELOVEDSTORY reserves the right to adjust prices and product availability without prior notice.
As most products are unique pieces, availability is limited. An item may occasionally be sold in-store before the online inventory has been updated.
If an ordered product is no longer available, the customer will be informed and any payment already received for that product will be refunded.
8. PAYMENT & TRANSFER OF OWNERSHIP
Payment methods available at checkout or in-store may include credit cards, cash, bank transfer and other payment methods offered by PRELOVEDSTORY.
Full payment is required before ownership of the purchased product is transferred to the buyer.
Orders are dispatched only after successful receipt or confirmation of payment.
9. SHIPPING & DELIVERY
PRELOVEDSTORY offers international shipping to supported destinations.
Shipping within Switzerland is complimentary. For international orders below CHF 500, a flat shipping fee of CHF 20 applies, unless otherwise stated at checkout.
Orders within Switzerland are usually delivered within 2–4 working days. International delivery times vary depending on the destination and customs procedures.
Deliveries are generally handled by Swiss Post, DHL, GLS or another suitable shipping provider.
International customers are responsible for any applicable import duties, customs charges and local taxes, unless explicitly stated otherwise.
Shipping times are estimates and may vary due to circumstances outside PRELOVEDSTORY’s control.
10. RETURNS, EXCHANGES & STORE CREDIT
PRELOVEDSTORY offers the following voluntary return and exchange policy, subject to applicable statutory rights.
In-Store Purchases
Clothing & Footwear
Clothing and footwear purchased in-store may be exchanged or returned for store credit within 7 calendar days of purchase.
Items must be unworn, unused and in their original condition, with all original tags attached. Proof of purchase is required.
Refunds to the original payment method are not offered for changes of mind.
Designer Handbags, Jewellery & Luxury Accessories
All in-store sales of designer handbags, jewellery and luxury accessories are final.
Returns, exchanges or refunds for changes of mind are not accepted.
Discounted Items
All discounted and sale items are final sale and are excluded from voluntary returns and exchanges.
Online Purchases
For online purchases governed by Swiss law and not subject to mandatory withdrawal rights, customers may request a voluntary return within 3 calendar days of receiving their order.
Approved returns are eligible exclusively for store credit equivalent to the purchase price of the returned item, excluding original shipping costs.
Customers must contact hello@prelovedstory.com within the return period to obtain return authorisation.
Returned items must be dispatched within 7 calendar days of receiving return authorisation and must be unworn, unused and in their original condition, including all original tags, packaging and accessories.
Return shipping costs and risks are borne by the customer, unless applicable law requires otherwise.
Store credit will be issued following receipt and inspection of the returned item.
Store Credit
Store credit is valid for 12 months from the date of issue and may be redeemed in-store or online.
Store credit cannot be exchanged for cash.
Items purchased using store credit are excluded from further voluntary returns or exchanges.
Statutory Rights
These voluntary return conditions do not restrict mandatory consumer rights, including any applicable rights relating to defective or counterfeit products.
Where mandatory withdrawal rights apply, including to certain international online purchases, the relevant statutory withdrawal period, refund rights and procedures take precedence over the voluntary policy above.
11. COMPLAINTS & DEFECTS
Customers are requested to inspect their purchases promptly upon receipt.
Any complaints regarding incorrect deliveries, missing items or material defects should be communicated to PRELOVEDSTORY in writing at hello@prelovedstory.com without delay after discovery.
Given the pre-owned and vintage nature of the products, signs of age, wear or imperfections disclosed or reasonably apparent at the time of purchase do not in themselves constitute defects.
Complaints concerning significant undisclosed defects will be assessed individually in accordance with the applicable contractual terms and law.
Nothing in these GTCs excludes or restricts liability or remedies where such exclusion or restriction is prohibited by applicable law.
12. LIABILITY
PRELOVEDSTORY handles all consigned products with reasonable care.
Liability for damage, theft, loss or other incidents is governed by the applicable Consignment Agreement and Swiss law.
PRELOVEDSTORY shall not be liable for indirect or consequential losses to the extent permitted by law.
No provision of these GTCs excludes liability for intentional misconduct, gross negligence or other liability that cannot legally be excluded.

14. SEVERABILITY
If any provision of these GTCs is found to be invalid or unenforceable, the remaining provisions shall remain in effect.
The invalid provision shall be replaced or interpreted, to the extent legally permissible, in a manner that most closely reflects its original purpose.
15. GOVERNING LAW & JURISDICTION
These GTCs are governed by Swiss law, excluding its conflict-of-law provisions.
The United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded to the extent permitted by law.
The place of jurisdiction is Zurich, Switzerland, subject to any mandatory statutory jurisdiction provisions.
ANNEX — PRODUCT CONDITION DEFINITIONS
0 — NEVER WORN, WITH TAG
An item that has never been worn and retains its original purchase tags.
No defects or alterations.
1 — NEVER WORN
An item that has never been worn but no longer has its original purchase tags.
No defects or alterations.
2 — VERY GOOD CONDITION
A carefully maintained pre-owned item showing minimal signs of use.
Minor signs of wear or professional alterations may be present and will be disclosed where relevant.
3 — GOOD CONDITION
A pre-owned item showing visible but acceptable signs of wear consistent with previous use.
Any relevant imperfections or alterations will be described or photographed.
4 — VINTAGE CONDITION
A vintage or older pre-owned item showing signs of age, wear or patina that are consistent with its history and character.
Such characteristics may include softened leather, patina, minor scuffs or signs of use on hardware.
Significant imperfections will be disclosed to the best of PRELOVEDSTORY’s knowledge.
